Beitragszeitbefreiung - Abmeldung - Kündigung - Wegfall Befreiungsgrund — 19 Dezember 2008, 16:31 — HKA

Ich habe einen Anspruch auf Taggeld mit Beitragsbefreiung geltend gemacht und Taggelder bezogen.

Nachdem ich eine Arbeitsvertrag unterschriben habe teilte ich der Arbeitslosenversicherung mit dem vorgesehenen Formular mit, dass ich nicht mehr Arbeitslos bin.

Jetzt hat der Arbeitgeber den Vertrag gekündigt. Ich kann keine 12-monatige Erwerbstätigkeit während den letzten 2 Jahren nachweisen, der Grund für die Befreiung von der Tätigkeit besteht zum aktuellen Zeitpunkt nicht mehr.

Läuft die wegen Beitragsbefreiung eröffnete Rahmenfrist für den Leistungsbezug weiter oder habe ich diese mit der Abmeldung beendet?

Welche Formulare muss ich von meinem Arbeitgeber ausfüllen lassen?

Hallo,

ich habe mich 20.07.2012 als arbeitslos gemeldet. Davor habe ich an einer Zürcher Hochschule studiert. In der dadurch entstehenden 2-jährigen Rahmenfrist für die Beitragszeit habe ich vom 20.07.2010 bis 30.06.2011 vorübergehend eine Teilzeitbeschäftigung als studentischer Hilfsassistent ausgeübt.

Der Arbeitsvertrag hätte zwar ursprünglich bis 31.12.2011 auf Stundenbasis verlängert werden sollen, ich habe mich aber kurzfristig anders entschieden und per 01.07.2011 gekündigt. Im Monat Juli 2011 wurde mir somit noch der 13. Monatslohn ausbezahlt. Der Arbeitgeber hat zudem meiner frühzeitigen Kündigung nicht Rechnung getragen und weist in der Arbeitgeberbescheinigung die Kündigung des Arbeitsverhältnisses per 31.12.2011 aus.

Meine Arbeitslosenkasse hat mich nun trotzdem vollständig beitragsbefreit mit der Begründung, dass ich eine beitragspflichtige Beschäftigung von nur 11.42 Monate ausweisen könne. Weil ich während meiner restlichen Studienzeit bis Juli 2012 nicht mehr gearbeitet hätte, könne sie mich vom Nachweis der Beitragspflicht befreien.

Ist dieses Vorgehen auch wirklich korrekt?
