Ich habe per Email eine Erweiterung zum Arbeitsvertrag. Dort ist besprochen, dass für eine Beteiligung der Firma an einer Weiterbildung und für eine Lohnerhöhung die Kündigungsfrist auf 6 Monate erhöht wird.

Es ist nie zur Weiterbildung gekommen, aber zur Lohnerhöhung. Ich habe keinen schriftlichen Vertrag.

Wenn ich jetzt kündige, sind die 6 Monate dann gültig?

Guten Tag!
Ich habe meine erste Arbeitsstelle seit rund einem Jahr nun angetreten. Zu Beginn bei der Aushandlung des Arbeitsvertrages wollten sie, dass ich im Arbeitsvertrag zustimme, für 2 Jahre hier zu arbeiten, da sie in Vergangenheit eine hohe Fluktuationsrate auf diesem Posten hatten. Sprich einen triftigen Grund für diese 2-jährige Frist hat der Arbeitgeber nicht (Saisonarbeit, Projektbasiert, ...). Ich habe dann unterschrieben, da sie mir gesagt haben, dass ein weiterer Kandidat in Frage käme, ich jedoch mit der Bereitschaft für 2 Jahre den Job bekommen würde. Da ich wirklich einen Job gebraucht habe, habe ich zugestimmt.
Nun sind jedoch die Arbeitsbedingungen prekär, weshalb ich gerne aus diesem Arbeitsverhältnis austreten möchte. Kann ich dies und was muss ich diesbezüglich beachten? Ein Kündigungsrecht habe ich ja quasi nicht mehr? Der einzige Schaden, den sie allenfalls durch frühzeitige Kündigung von mir erleiden würden, wären die Einarbeitungskosten eines neuen Arbeitnehmers. Diese Einarbeitung könnte ich jedoch vornehmen, weshalb es keinen wirklichen Schaden an sich gäbe (Umsatzverlust, Verlust von Kundentreue, Qualitätsverlust, der gegen aussen sichtbar wäre, ...). Können sie, falls ich also frühzeitig gehe, einen Schadenersatzanspruch geltend machen? und habe ich trotzdem das Anrecht auf ein faires, objektives Arbeitszeugnis?
