Ich habe in Dezember 2009 in einen Hotel in der Schweiz gearbeitet. Nach zwei Wochen habe ich gekündigt und Kündigungsfrist eingehalten. Alles schriftlich festgahlten. Nun warte ich seit zwei Monaten auf meinen Gehalt. Den Arbeitgeber steckt in finanziellen schwierigkeiten (so würde den Telefon abgestellt vom Swisscom)und auf Aufforderung meinerseits, gab es den Antwort: Ich soll doch ein Antwalt suchen. Was kann ich tun um an mein Gehalt zu kommen?

Seit Januar habe ich (Deutscher) eine Anstellung mit einem Grundgehalt (Gesellentarif, obwohl seit 40J. Meister im Beruf) zuzügl. “FIXBETRAG” brutto 300 Fr. für Nachtzuschlag, da dies angeblich für mich günstiger sei…; im Januar war alles ok und seit Februar werden mir regelässig 140 Fr. abgezogen, auf meine Frage wieso, hies es, ich hätte weniger Nachtstunden gehabt! Da ich kurz vor der Rente stehe (noch 10 Monate) traue ich mich nicht, hier gegen an zu gehen, da ich dann sicher mit der Kündigung rechnen muss. Das Geld fehlt mir im Geldbeutel und auch in der AHV.

FIX lt. Vertrag heisst doch pauschal oder kann Arbeitgeber machen, was er will?

Der jetzige Arbeitgeber hat aufgrund meines Alters 9.000 Fr. von der RAV als Einarbeitungszuschuss bekommen. Was kann ich tun; fühle mich total rechtlos; ich war - davor - arbeitslos bei einem Arbeitgeber, der mir ebenfalls Lohn schuldig blieb, da habe ich einen Titel über 7.200 Fr., die ich jedoch nie sehen werde, Konkurs mit 1,3 Mio im Okt.2010 angemeldet.

Wer kann mir einen Rat geben, wie ich mich verhalten soll. DANKE

Ich habe bei meinem Arbeitgeber auf Ende Dezember 2011 gekündigt. Der Betrieb musste jedoch schon Ende November 2011 schliessen, aus finanziellen Gründen. Ich habe keinen Lohn bekommen für den Monat Dezember, obwohl die Chefin es geschrieben hat dass sie mich bis Ende Dezember bezahlt. Der Betrieb ist eine Kollektivgesellschaft. Muss sie zahlen und wie kann ich meinen Lohn einfordern?
