<p>Hallo zusammen.
<br />Ich hätte eine Frage bezüglich der Gratifikation am Ende des Jahres.
<br />Und zwar steht in meinem Arbeitsvertrag wörtlich:" 
<br />Als Jahresendzulage wird im Dezember bei ganzjähriger Beschäftigung eine Gratifikation eines 13. Monatsgehalt (exkl. Spesen), abzüglich Sozialleistungen ausbezahlt.
<br />Die Firma XXX weist darauf hin, dass die Entrichtung der Gratifikation
<br />unmissverständlich auf die Freiwilligkeit beruht. Die Gratifikation ist eine ausserordentliche Zulage
<br />(Sondervergütung), die zum Lohn hinzutritt und bei bestimmten Anlässen ausgerichtet wird. Sie
<br />hängt stets in einem gewissen Mass vom Willen des Arbeitgebers ab. Eine Gratifikation muss
<br />übrigens nicht, um als solche zu gelten, notwendigerweise immer die gleiche Höhe aufweisen. Der
<br />Betrag kann von Jahr zu Jahr variieren (OR 322d)."
</p>
<p class='vspace'>Der Arbeitgeber hat diese Gratifikation nun über 3 Jahre mehr oder weniger pünktlich auf Ende Jahr ausbezahlt. Nun weigert er sich aber diese Gratifikation auszubezahlen und beruft sich darauf, dass diese freiwillig sei und dass das Jahr schlecht gelaufen sei, was im Übrigen nicht stimmt, lediglich der Dezember war Flaute, wie fast jedes Jahr.
</p>
<p class='vspace'>Wie sehen nun meine Rechte im Bezug auf die Einforderung dieser Gratifikation aus?
