<p>Frage: Ich war bis zur Geburt meines Kindes leitende Angestellte mit einem Kadervertrag. Die Position entspricht einem Pensum von 100%, welches ich nach dem Mutterschaftsurlaub nicht mehr voll wahrnehmen kann, weshalb ich sie abgeben musste. Ich werde zu einem reduzierten (60%) Pensum zurückkehren. Nun meine Frage, darf der Arbeitgeber mich problemlos vom Kadervertrag in den GAV zurückstufen? Für den neuen Job bin ich im Prinzip überqualifiziert, da ich die Abteilung bisher geleitet habe. Kann ich auf meinen "alten" Lohn bestehen oder muss ich die Herabstufung kommentarlos akzeptieren?
