<p>Im Rahmen meiner Funktion bin ich viel unterwegs und benutze deshalb einen Firmenwagen. Dieser Firmenwagen darf ich auf privat unlimitiert benutzen. Leasing, Unterhalt, Versicherung und alle Treibstoffkosten werden unbeschränkt vom Arbeitgeber übernommen. Das Fahrzeug wird auf meiner Lohnabrechnung mit einem Wert von CHF24678.95 beziffert und auf meiner Lohnabrechnung monatlich als jeweils CHF196.95 ausgewiesen. Gemäss Lohnabrechnung handelt es sich hier um "natural funding" resp. "not added to the total of the gross salary". Das heisst mit anderen Worten, dass die CHF196.95 weder zu meinem Lohn dazugezählt noch davon abgezogen werden.

<p class='vspace'>Ich bin nun schwanger und erwarte bald ein Baby. Mein Arbeitgeber hat angedeutet, dass er mir während meines Mutterschaftsurlaubes das Fahrzeug nicht zur Verfügung stellen werde "weil er es angeblich während dieser Zeit benötige". Abgesehen davon, dass ich weiss, dass dieser angebliche Bedarf nicht den Tatsachen entspricht, bin ich privat auf das Fahrzeug resp. den Genuss der Deckung der Treibstoffkosten etc. angewiesen und habe bei Stellenantritt mein eigenes Fahrzeug verkauft, weil der Arbeitgeber darauf bestand, dass in dieser Position ein Firmenwagen benutzt werde. Ausserdem müsste ich bei vorübergehender Einziehung des Fahrzeuges plötzlich ein Auto mieten, was einer substantiellen Kürzung meines Salärs gleichkommen würde. Den CHF196.95 wird waerend die Mutterschaftpause nicht von mein Lohn abgezogen.
<br />Darf der Arbeitgeber so handeln?
