Hallo zusammen!

Ich bin Polymechaniker, zurzeit noch in der Lehre.
Bei und im Betrieb ist es üblich, dass Lehrlinge, infolge von "Strichen", Samstagsarbeit verrichtenmüssen. Wir werden infolge dreier Striche zur Samstagsarbeit aufgeboten. Diese Arbeit ist dabei KLAR eine Strafe und wird weder in Stundenkompensation noch entgeltlich vergütet. Wir arbeiten von 8-12 Uhr gratis! Striche bekommen wir für viele unnötige Dinge, welche nach Lust und Laune verteilt werden.

Es ist noch zu erwähnen: Die verrichteten Arbeiten sind keine übungen. Die Arbeit ist produktiv und die Firma verdient damit.

Meine Frage ist ob ich mich weigern darf bei dieser Prozedur mit zu machen. Also mein Arbeitgeber verstösst damit Grundsätzlich schon einmal auf folgendes:

"Der Arbeitnehmer hat Anspruch auf Lohn für seine Leistung"

"Vereinbarte Arbeitszeit: Sie wird in der Regel individuell zwischen den Vertragsparteien
geregelt. Wird diese Arbeitszeit überschritten, so spricht man von
„Überstunden“.

• Überstunden (gemäss Art. 321c OR): Im Einverständnis mit dem Arbeitnehmer
kann die Überstundenarbeit durch Freizeit von mindestens gleicher Dauer
kompensiert werden. Falls kein Ausgleich durch Freizeit erfolgt, so ist grundsätzlich
ein Lohnzuschlag von 25% geschuldet.

• Überzeit im Sinne von Art. 12 und 13 ArG steht in keinem Zusammenhang mit
der vertraglich vereinbarten Arbeitszeit. Sie liegt dann vor, wenn die gesetzlichen
Höchstarbeitszeiten gemäss ArG überschritten werden. Die Überzeit kann
durch Lohnzuschlag von wenigstens 25 Prozent oder durch Kompensation mit
Freizeit abgegolten werden. Unter Vorbehalt der Kompensation der Überzeit
durch Freizeit, ist der Lohnzuschlag ZWINGEND.

Also, übersehe ich etwas oder verstösst da jemand gegen das Gesetz? Ich bin jedoch nicht sicher ob Lehrlinge eventuell bestraft werden dürfen. Ich finde leider nichts konkretes bezüglich Strafen.

Mein Rat Alles detailiert aufschreiben( wan wo was gearbeitet), nach Ende deiner Lehre das Geld mit Anwalt holen (Anschpruchsrecht bis 2 Jahre) Falls die Firma dich behält danach kannst Du drauf verzichten. Mein Anwalt fand damals noch weitere "Austände" die wir fordern konnten und auch bekammen!
