Guten Abend

Ich arbeite in einer kleinen, knapp 10-Mann grossen Firma. Ich habe mich darauf eingelassen, einen etwas tieferen Fixlohn zu haben, dafür werde ich zu einem kleinen Prozentsatz an Projekten beteiligt (die Arbeit besteht nur aus solchen). Das klappt soweit auch gut. Ich muss die Projekte nicht akquirieren und schulde auch keinen Erfolg, ich muss lediglich die Arbeit ausführen.

Folgende Situation aber jetzt: infolge Schlampigkeit des Vorgesetzen wurden einige Projekte nicht schriftlich durch den Klienten bestätigt. Ich habe mehrfach (!) meinen Chef deutlich darauf hingewiesen, dass doch bitte Honorar und sonstige Rahmenbedingungen schriftlich geregelt werden - ich wurde aber grosszügig ignoriert. Ich habe mir - auf gut Deutsch - den Hintern für diese Projekte aufgerissen und sehr viele Überstunden geschoben. Das ist mir an und für sich egal bzw. dazu bin ich selbstverständlich bereit - jetzt will der Kunde aber nicht zahlen, behauptet, man hätte nichts vereinbart und als Resultat soll ich meine Provision nicht kriegen.

Ich bin der Meinung, dass das so nicht korrekt ist. Ich war weder am Briefing/der Akquise dabei, noch schulde ich Erfolg, zudem habe ich wirklich deutlich gesagt, dass ich dem Kunden nicht traue und für eine schriftliche Vereinbarung bin (die wir nota bene selbst bei langjährigen, treuen Kunden immer noch verlangen, umso dümmer war es von meinem Chef, bei einem Neukunden nicht darauf zu bestehen). Ich sehe nicht ein, dass ich den Kopf hinhalten muss, weil meiner Meinung nach hat deutlich mein Chef versagt. Da es sich bei der Provision dieses Mal um einen recht hohen Betrag handelt, bin ich auch nicht bereit, den einfach mal eben so "abzuschreiben".
